Confidence Group is facing questions regarding the possibility of foreign persons to enter Russian Federation for business purposes in view of the new Order of the Government of Russia No. 1291-r dated 18.05.2021, published on May 18, 2021. This Order set out the norms of the Order of the Government No. 635-r in a new edition.
However, the situation is not as simple as it might seem at first glance.
By the decision of the Operational Headquarters dated May 14, 2021, a new Algorithm for the entry into Russia of foreign citizens arriving on business trips and participating in negotiations and the implementation of investment projects was approved.
According to this Algorithm, all requests for entry permits must be addressed to the highest official of the constituent entity of the Russian Federation in whose jurisdiction the organization is. From there, processed and duly approved applications will be sent to the Ministry of Economic Development for further coordination with the Federal Security Service (FSB), the Ministry of Internal Affairs (MIA), and uploading to the Unified Portal of Public Services (EPGU). Further, the lists of arrivals will be formed, which will be uploaded to the EPGU system and transferred to all Russian border checkpoints and to the MIA.
At the same time, a foreign investor must meet one of the following criteria:
- a foreign investor is the owner or head of a legal entity operating on the territory of the Russian Federation;
- the participation of a foreign investor in negotiations on the implementation of an investment project on the territory of the Russian Federation is planned, which is confirmed by the petition provided for in paragraph 1 of the Algorithm;
- it is planned to sign by a foreign investor agreements / contracts aimed at the implementation of an investment project on the territory of the Russian Federation, which is confirmed by the petition provided for in paragraph 1 of the Algorithm.
