Also, messages appeared online on the official websites of the territorial divisions of the Ministry of Internal Affairs that the Ministry of Internal Affairs in the Moscow region, from November 1, 2023, does not accept notifications of the arrival of foreign citizens from individual entrepreneurs and legal entities, inviting them to submit these notifications to the Odintsovo Multifunctional Migration Center.
Meanwhile, the refusal of the Ministry of Internal Affairs to accept notifications from individual entrepreneurs and legal entities is unlawful.
At the moment, there are still rules in force according to which notification of the arrival of foreign citizens and stateless persons can be provided in the following ways:
- to the territorial body of the Ministry of Internal Affairs of Russia directly - in person or in electronic form;
- through the Multifunctional Center;
- by post.
In accordance with the Regulations, the Ministry of Internal Affairs is also prohibited from requiring the applicant to take actions necessary to obtain state migration registration services related to applying to other government bodies and organizations.
(Clause 2 of Article 22 of the Law “On Migration Registration of Foreign Citizens and Stateless Persons in Russia” dated July 18, 2006 No. 109-FZ, paragraphs 20 and 22 of the Procedure for Migration Registration, paragraphs 21, 22, 23 and 150 of the Administrative regulations on the provision of state services for migration registration)
We assume that this may be due to the fact that at the end of 2022 a bill was submitted to the Russian State Duma for consideration, which is intended to expand the practice of involving subordinate Ministry of Internal Affairs of Russia, as well as authorized organizations of constituent entities of the Russian Federation, in assisting the Ministry of Internal Affairs in the provision of public services in the field of migration, and namely, the enterprise “Passport and Visa Service” (PVS).
It is expected that the PVS will assist the Ministry of Internal Affairs in providing the following services:
1) acceptance of applications for registration, issuance, extension of validity and restoration of visas
2) acceptance of applications, petitions and other documents necessary for registration and issuance (issuance takes place at the Ministry of Internal Affairs):
- temporary residence permit
- Residence permit (+ replacement)
- patents (registration and re-registration)
- permits to attract foreign labor
- work permits
- invitations to enter Russia
- passports
3) carrying out mandatory state fingerprint registration of foreign citizens and taking their photographs
4) acceptance of the following documents:
- statements, petitions for extending the period of temporary stay of foreigners in Russia;
- notifications from foreigners permanently or temporarily residing in Russia confirming their residence in Russia;
- notifications from the employer or customer of work (services) about the conclusion and termination of labor and civil law contracts with foreign citizens;
- notifications about the fulfillment of obligations to pay wages to HQS;
- copies of employment and civil law contracts from foreign citizens working on the basis of a patent;
- notifications about the provision to a foreign citizen
academic leave, completion, early termination, unauthorized departure of a foreign citizen from an educational organization;
- notifications of the arrival of a foreign citizen at the place of stay and attached documents;
- applications for registration of a foreign citizen at the place of residence.
In the current version of the bill we are talking about “assistance”, PVS are everywhere added to the list of institutions providing such services, it does not exclude the provision of the listed public services also by the Ministry of Internal Affairs. The explanatory note to the bill states that it is intended to ensure increased accessibility and comfort when applicants receive relevant public services.
This bill has only passed the first reading; changes may occur before the second reading and publication (if adopted).
