The Decree makes the following changes:
- clarified the procedure for renunciation of Russian citizenship by a child under 14 years of age at the request of both parents or a single parent, if both parents are foreign citizens (previously established by paragraph 25 of Decree of the President of Russia dated November 14, 2002 No. 1325 applied only to cases where one of the parents child is a citizen of Russia, and the other is a foreigner, or the only parent is a foreign citizen)
- the fact that a child under the age of 14 has Russian citizenship by birth can be certified by a birth certificate with a mark confirming the presence of Russian citizenship also if the birth certificate contains information about his birth in Russia by a surrogate mother. At the same time, a document of the authorized body of a foreign state is provided, confirming the absence of grounds for granting the child citizenship of this state by birth.
- if a child born in Russia by a surrogate mother is left without parental care, and he does not have a birth certificate with information about Russian citizenship of both parents, one of the parents or a single parent, or a birth certificate with a mark confirming the presence of Russian citizenship affixed by an official of the authorized body, or a birth certificate with an ins ert confirming the presence of Russian citizenship, issued in accordance with the previously established procedure and retaining its validity, his or her citizenship is issued in accordance with the resolution of the head of the authorized body on issuing a child a passport of a Russian citizen, including a foreign one passport, or by affixing a mark on the child's birth certificate confirming the presence of Russian citizenship
- along with an application for registration of the presence of Russian citizenship in a child born by a surrogate mother and left without parental care, in addition to a birth certificate, documents or information confirming the fact of the birth of a child in Russia by a surrogate mother are provided. If necessary, the competent authority shall verify this information.
The decree entered in to force on the date of its publication, that is, July 03, 2023.
