Also in February 2024, a similar draft law authored by the Russian Ministry of Labor was submitted for discussion; its text and progress of consideration can be found on the official website of the draft laws.
According to messages on the Telegram channel of the official representative of the Ministry of Internal Affairs of Russia Irina Volk, the draft law is still under consideration by the Russian Government; it has not yet been submitted to the State Duma of Russia.
The draft law contains the following legal innovations:
1. It is proposed to lim it the time of temporary stay of foreign citizens in Russia to no more than 90 days in total during a calendar year (currently, temporarily staying foreign citizens can stay in Russia for 90 days within 180 days).
2. Introduction of a regime of “controlled stay” of foreign citizens in Russia. This regime will be established in relation to persons to whom government authorities have made decisions that prevent them from leaving Russia.
3. Creation of the so-called digital profile of a foreign citizen, which is a set of information about a foreign citizen contained in the information systems of government bodies and organizations that are linked by a single unique identifier.
4. Introduction of a single document certifying the identity of a foreign citizen on the territory of Russia, replacing all currently issued documents confirming the right to reside and work in Russia.
5. Implementation of registers of employers and foreign workers. Employers and customers of work or services will be able to attract foreign workers provided they are included in the appropriate register; foreign citizens will be included in the appropriate register when they receive the legal right to work in Russia.
6. It is proposed to include in the duties of the police the functions of administrative supervision over the stay (residence) of foreign citizens in Russia. Supervision involves the use of powers established by the law "On Police", as well as all new powers in the field of migration.
7. Foreign citizens will be asked to sign a loyalty agreement, which will represent the foreign citizen’s consent to the possible restriction of his right to enter, stay and reside in Russia in case of violation of Russian legislation.
According to the explanations of the official representative of the Ministry of Internal Affairs of Russia, the introduction of digital profiles, a single electronic document and registers of employers and employees will enable government bodies, organizations and citizens to receive electronic confirmation in real time of the legality of the stay of foreigners in Russia, and the introduction of a controlled stay regime will create the necessary conditions for practical implementation of measures related to the restriction of certain rights of foreign citizens and the imposition of additional responsibilities on them.
