Currently, foreign citizens with an existing (not cancelled or expunged) criminal record are not allowed to enter Russia (Clause 3, Article 27 of the Law “On the procedure for leaving Russia and entering Russia” 114-FZ). The draft law proposes to amend this paragraph of Article 27, extending the ban on entry into Russia also to cases where a criminal record has been cancelled or expunged.
This does not depend on the severity and type of crimes - if this law is adopted, the entry ban will apply to foreign citizens convicted of committing crimes not only of grave and especially grave, but of minor and moderate gravity.
Also, the same initiative group introduced a draft law to amend the Law on the Legal Status of Foreign Citizens 115-FZ. In accordance with this draft law, it is planned to expand the list of grounds for refusing to issue temporary residence permits and residence permits to foreign citizens, as well as for canceling previously issued temporary residence permits and residence permits.
It is proposed to include in the list of grounds for refusal to issue and cancel previously issued temporary residence permits and residence permits the commission by foreign citizens of crimes of any category of gravity established by a court verdict, the presence of an unexpunged and uncancelled criminal record, as well as in the event that a criminal case against a foreign citizen is terminated for non-rehabilitative reasons.
Family members of foreign citizens convicted of committing a crime are also offered to cancel temporary residence permits and residence permits.
In addition to crimes, temporary residence permits and residence permits are proposed to be canceled for committing a number of administrative offences. Such offenses are proposed to include offenses related to encroachment on institutions of state power, assault, prostitution or receiving income from prostitution, promotion of non-traditional sexual relationships, gender reassignment, pedophilia, and promotion of illegal narcotic drugs.
According to the explanatory note to both draft laws, they are considered to prevent significant harm from being caused to Russian citizens and violations of their basic rights, to help reduce the number of migrants whose activities pose a public danger to Russian citizens, to reduce the crime rate among migrants and in general. It is expected that all this will have a beneficial effect on interethnic relations in Russia.
