In continuation of the previously published news, we would like to inform that on May 9, 2017, in connection with the FIFA World Cup 2018, the President of Russia adopted the Decree № 202 imposing restrictions on the arrival and stay in the cities where the championship is held, for Russian and foreign citizens.
The paragraph "d" of art. 4 of this Decree provides that in the cities of Kazan, Moscow, St. Petersburg, Sochi between June 01 and July 12, 2017, as well as the cities of Volgograd, Ekaterinburg, Kazan, Kaliningrad, Moscow, Nizhny Novgorod, Rostov-on-Don, Samara, St. Petersburg, Saransk, Sochi from May 25 to July 25, 2018 registration at the place of stay or registration at the place of residence of foreign citizens and stateless persons (arrived for temporary stay or permanent residence) is carried out within one day on the day of their arrival at the place of stay or residence with the presentation of the documents provided by the legislation of the RF, by the receiving party either directly by foreign citizens or stateless persons in the relevant territorial authority of the Ministry of Internal Affairs.
Thus, the migration registration of temporarily staying foreign citizens must be carried out within one day. This requirement does not apply only to foreign citizens and stateless persons who are participants of the World Cup, Confederation Cup, as well as representatives of FIFA, affiliated organizations of FIFA, confederations and national football associations included in the FIFA lists.
We would like to draw your attention to the fact that in addition to the fans who come to the respective event, all foreign citizens who arrived for temporary stay (temporary or permanent residence), are under this Decree, including:
- highly qualified specialists (and members of their families);
- citizens of the EEU member countries;
- foreign citizens who work on the basis of work permits;
- foreign citizens who work on the basis of patents.
Migration registration of fans is carried out by hotels, hostels or individuals, where they live.
The procedure for migration registration of foreign workers is not changed.
The Decree limits the methods of migration registration. In order to make a migration registration of a foreign citizen at the place of residence the host country or a foreign national shall provide notification of the arrival to the Interior Ministry directly to the body of migration registration (Department on migration issues of the Ministry of internal affairs). The Decree doesn’t provide the notification on the arrival to the body of migration registration by mailing or handling in MFC.
Unfortunately, the Decree does not take into account all the difficulties that may arise in case of arrival of foreign citizens in Russia over the weekend, when migration registration within one day is problematic. Nevertheless, the requirement for migration registration within 24 hours remains. In this regard, Confidence Group would like to recommend that employers:
- whenever possible, ask foreign workers to postpone their trips during this period;
- ask foreign workers when planning to enter Russia on Friday or Saturday to warn their employer (the receiving party) about it in advance.
Confidence Group recommends paying special attention to this issue, to prepare in advance the forms of migration registration and promptly send data on the entry of foreign citizens.
