In continuation of previously published news we inform you that on April 1, 2019 instead of SNILS (insurance number of an individual personal account) a document confirming registration in the system of individual (personified) accounting was entered. These changes were made by the Federal Law as of 01.04.2019 N 48-ФЗ to the Federal Law "On individual (personalized) accounting in the system of compulsory pension insurance".
Previously, the registration of SNILS was required for citizens of Russia, as well as for any foreign citizens in Russia, except for highly qualified specialists. However, since April 1, 2019, a highly qualified specialist will need to register an individual personal account in the individual (personalized) accounting system - in accordance with Art. 6 of the Federal Law "On individual (personalized) accounting in the system of compulsory pension insurance".
Also registration of an individual personal account in the system of individual (personalized) accounting will be required for any foreign citizens in Russia and citizens of Russia in accordance with the above rule.
This registration is carried out by the Pension Fund of Russia.
At the same time, despite the fact that highly qualified specialists will need to register an individual personal account in the system of individual (personified) accounting, pension insurance in accordance with Part 2 of Art. 22.1 of the Federal Law "On Compulsory Pension Insurance in the Russian Federation" continues to not apply to them (and this provision remains unchanged).
Persons who already have a SNILS do not need to reissue this document - the previously issued SNILS remain valid.
Highly qualified specialists working under previously concluded employment contracts must register in the system of individual (personified) accounting.
On April 1, 2019 in Art. 65 of the Labor Code of Russia, changes were made - now when concluding an employment contract, the employee must present the employer not "an insurance certificate of mandatory pension insurance" (which was not required for a highly qualified specialist), but "a document confirming registration in the individual (personified) accounting system, including in the form of an electronic document "(which is required from April 1, 2019 to a highly qualified specialist, as well as to any other foreign citizens in Russia and citizens Russia).
Evasion of this duty may entail liability under Part 1 of Art. 5.27 of the Administrative Code (warning or imposition of an administrative fine on officials in the amount of from one thousand to five thousand rubles; on persons engaged in entrepreneurial activities without forming a legal entity - from one thousand to five thousand rubles; on legal entities - from thirty thousand to fifty thousand rubles).
