In accordance with this law, the right to additional measures of state support will arise upon the birth (adoption) of a child only under the following conditions:
- the child’s parents had Russian citizenship at the time of the child’s birth;
- the child is a Russian citizen by birth.
Previously, the Federal Law “On Additional Measures of State Support for Families with Children” did not specify that in order to receive maternity capital, parents must have Russian citizenship at the time of the child’s birth, and that the child must be a Russian citizen by birth, and therefore citizenship In a number of cases, foreign citizens purchased Russia in order to receive these support measures, which, according to the legislator, contradicted the original purpose of the project of additional measures to support families with children.
The provisions of the law do not apply to Russian citizens who did not have Russian citizenship and permanently resided in the territories of the DPR, LPR, Zaporozhye region and Kherson region on the birthday (adoption) of the child as of the day of the admission of these republics to Russia.
Please note that the law does not indicate that it extends its effect to legal relations that arose before its entry into force, therefore, as a general rule, it does not have retroactive effect, and children who received Russian citizenship before January 1, 2024, are still entitled to additional government support measures.
The law comes into force on January 1, 2024.
