We wrote about the start of the drafting of the draft law and its preparation for submission to the State Duma in our news.
The effect of the draft law in its current version extends to four regions - Moscow, Moscow Region, St. Petersburg and Leningrad Region.
The draft law provides for the right of the heads of adjacent regions (Moscow and Moscow Region, St. Petersburg and Leningrad Region) to conclude special agreements that will establish the right of foreign citizens who have received a patent in one region to work under the same patent in a neighboring region.
Such agreements may be concluded only in the case of mutual compliance of the coefficient reflecting regional characteristics of the labor market in accordance with paragraph 3 of Article 227 of the Tax Code of Russia (i.e., before concluding agreements, the regions must agree on the general amount of the coefficient), as well as the presence (absence) of a decision to indicate in the patent the profession (specialty, position, type of work activity) of a foreign citizen in accordance with paragraph four of paragraph 29 of Article 133 of 115-FZ (such a decision must also be the same for both regions).
The agreement must define the start date of the agreement and the conditions for providing an interbudgetary transfer between the regions of the agreement.
The agreement may include information about the profession in which foreign citizens can work in the territory of two regions, restrictions on the duration of work under such a patent outside the boundaries of the entity of Russia in which the patent was issued to the foreign citizen, as well as other conditions for interaction between the entities on this issue.
In the explanatory note, the developers of the draft law indicate that the adoption of these amendments will have a positive impact on the country's economy, especially in areas related to seasonal employment and construction.
If the amendments are adopted, they are scheduled to come into force on September 1, 2025.
