According to the Ministry of Foreign Affairs, this agreement was terminated on January 1, 2023.
The termination of this agreement, however, does not mean that Ukrainian citizens are required to obtain a visa to enter and stay in Russia.
At the same time, Russian citizens from July 1, 2022 can enter Ukraine only with a visa (more details in our news), since this Agreement was initially denounced by Ukraine unilaterally.
Decree of the President of Russia dated August 27, 2022 No. 585 is still in effect, according to which citizens of Ukraine can stay in Russia without a time lim it (but they are obliged to undergo fingerprinting, photography and medical examination within 90 days after entry).
The documents required for citizens of Ukraine to enter Russia are listed in Decree of the President of Russia dated September 29, 2023 No. 734 “On the procedure for entry into Russia and departure from Russia for citizens of Ukraine,” namely:
- passport of a citizen of Ukraine (internal passport);
- passport of a citizen of Ukraine for traveling abroad (foreign passport);
- diplomatic or service passport;
- birth certificate (for children under 16 years of age);
- passport of a citizen of Ukraine - the legal representative of a minor citizen, which contains information about the child (for the departure of a minor citizen accompanied by a legal representative);
- seafarer's identity card;
- ID card for returning to Ukraine (only for returning to Ukraine);
- certificate of an aircraft crew member.
There are no visas among the documents listed in Decree No. 734; moreover, according to this decree, entry into Russia is possible for Ukrainian citizens even if the validity of the listed documents has expired.
There is a common misconception that the canceled Agreement exempted Ukrainian citizens from the obligation to register for migration within 90 calendar days. However, this opinion is incorrect, since the Agreement came into force in 1997, while the Federal Law on Migration Registration 109-FZ, which introduced the concept of “registration at the place of stay of a foreign citizen” and established its terms and conditions, was published and entered into into force in 2006. The concept of “registration at the place of residence of a foreign citizen” is absent in the Agreement; therefore, the provisions of Part 2 of Article 1 of the Agreement were inapplicable, and citizens of Ukraine, even during the validity of the Agreement, were required to register for migration within 7 days from the date of entry into Russia. The same obligation remains with them even after the termination of the Agreement, that is, there were no changes in the procedure for registering Ukrainian citizens for migration after the announcement by the Ministry of Foreign Affairs.
Please note that for Ukrainian citizens who are highly qualified specialists (HQS), the migration registration rules relating to HQS apply, that is, such citizens and their accompanying family members may not register for migration within 90 days from the date of entry into Russia. After the expiration of the specified period, they must register at their place of stay within 7 days.
We remind you that from October 16, 2023, there is a special procedure for entry into Russia for citizens of Ukraine, established by the Russian Government.
