On January 10, 2018, the Ministry of Internal Affairs of Russia adopted Order No. 11 as of 10 January 2018 on forms and procedure of notifying the Ministry on foreign citizen's labor activity in Russia
This order will come into force on April 20, 2018.
In connection with the adoption of this MIA order, the Order of FMS of Russia as of June 28, 2010 N 147 on forms and process of notification of the FMS about work of foreign citizens is repealed.
In accordance with this Order of MIA, the employer (the customer of works, services) is obliged to notify the territorial body of the Ministry of Internal Affairs of Russia in the subject of Russia (where a foreign citizen works) on conclusion and terminating the contract with this foreign citizen within a period not exceeding 3 working days from the date of conclusion or termination of the relevant contract.
The following numbered applications was approved by the new order of the Ministry of Internal Affairs:
- The form of the request of a foreign citizen to attract him as a highly qualified specialist (hereinafter - HQS);
- The procedure for completing the application of a foreign citizen to attract him as a HQS;
- The form of notification on employment of a foreign citizen by an organization that provides employment services for foreign citizens on the territory of Russia;
- The procedure of the submission by the organization providing employment services for foreign citizens on the territory of Russia, notification of the employment of a foreign citizen;
- Form of HQS salary notification - HQS;
- The procedure for submission by employers and customers of works (services) HQS salary notifications;
- Form of notification of the conclusion of an contract for work with a foreign citizen studying in Russia;
- Form of notification of the termination of an contract for work with a foreign citizen studying in Russia;
- The form of the notification on granting leave without pay for more than one calendar month during the year to a foreign citizen studying in Russia;
- The procedure for the submission by employers or customers of works (services) of notification of the conclusion and termination of employment contract for work with a foreign citizen studying in Russia, as well as provision of vacations without pay for more than one calendar month during the year;
- Form of notification of completion or termination of training of a foreign citizen working in Russia and who has studied in Russia or on granting of academic leave to a foreign citizen;
- The procedure for submitting a notification by a professional educational organization or educational institution of higher education about the completion or termination of training for a foreign citizen working in Russia and who has studied in Russia, or about granting of academic leave for foreign citizen;
- Form of notification of conclusion contract with a foreign citizen;
- Form of notification of termination contract with a foreign citizen;
- The procedure of submission by employers or customers of works (services) of notices on conclusion and termination contract with foreign citizens.
