On July 10, 2024, a draft law on a simplified residence permit for those whose relatives had lived on the territory of the USSR, as well as on establishing the period of stay in Russia for citizens with terminated Russian citizenship, was adopted in the first reading
On July 10, 2024, the
draft law “On Amendments to the Federal Law “On the Procedure for Exiting and Entering Russia” and the Federal Law “On the Legal Status of Foreign Citizens in Russia” was adopted in the first reading.We wrote about the preparation of the draft law and its submission for consideration in our news.
The draft law was developed to bring some laws into compliance with the provisions of the Law “On Citizenship of Russia”, which came into force in October 2023.
A number of changes are planned to make, in particular:
▪ To supplement the law “On the legal status of foreign citizens in Russia” with an article establishing the period of temporary stay in Russia in the event of termination of Russian citizenship:
- 90 days in case of voluntary expression of will or on other grounds provided for by an international treaty of Russia, providing the opportunity to maintain or change citizenship.
- 15 calendar days in case of termination of citizenship due to presentation of false documents when receiving citizenship (except for cases where, within the specified period, an identification procedure has been initiated for such persons in order to obtain a temporary identity card for a stateless person in Russia or accepted application for the issuance of such a document)
▪ Provide the right to a simplified (without first obtaining a temporary residence permit) obtaining a residence permit for those whose relatives in the direct ascending line permanently reside in the territory of the Russian Empire or the USSR.
▪ Preserve the right for foreign qualified specialists to obtain a residence permit in a simplified manner, while increasing the period of labor activity required for this from six months to a year before the date of application for a residence permit (subclause 10 of clause 2 of Article 8 of Law 115-FZ). The list of professions giving this right was approved by Order of the Ministry of Labor of Russia dated May 15, 2023 N 460n.
▪ The draft law also proposes to abolish the provisions of federal laws No. 114-FZ and No. 115-FZ, which provide for separate preferences for native speakers of the Russian language, since this concept was excluded from the new law on Russian citizenship.
