On October 1, 2024, amendments to the
draft law aimed at limiting the possibility of obtaining a temporary residence permit and residence permit on the basis of fictitious family relationships were adopted in the second reading. We wrote about this bill at the stage of its submission to the State Duma of Russia for consideration earlier in our news.After the draft law was submitted, a number of amendments to it were proposed and adopted, namely:
1) the period of marriage with a Russian citizen required to obtain a temporary residence permit outside the quota is proposed to be increased by up to 3 years;
2) the period of marriage is proposed to be counted directly before the day of applying for a temporary residence permit;
3) to obtain a residence permit based on having a common child with a Russian citizen who is a Russian citizen, it is proposed to require judicial confirmation of the fact of cohabitation directly with this child on the territory of Russia for at least 2 years before the moment of filing the application;
4) a residence permit issued on the basis of marriage with a Russian citizen is proposed to be annulled if such marriage was dissolved;
5) in case of restriction of parental rights, it is proposed to revoke the residence permit obtained in a simplified manner by the parents of a child who is a Russian citizen permanently residing in Russia.
In order for the draft law under consideration to become a law, it must undergo a third reading, be approved by the Federation Council and signed by the President of Russia.
