In the Moscow region, the Ministry of Internal Affairs requires the presence of the company's executive director when applying for the initial issuance and renewal of work permits
The Confidence Group company reports that currently the stuff of the Department of Internal Affairs of the Main Directorate of the Ministry of Internal Affairs of Russia for the Moscow Region is calling the heads of all organizations that submit documents for a work permit to their employees - highly qualified specialists (HQS).The presence of the head of the company is required both when initially submitting documents for a work permit, and when applying for an extension of a work permit. At the same time, the presence of the head of the company is now always required (previously, the executive director could be called only in some cases during the initial application for work permit of the HQS).
Of course, such requirements are not legal, and in accordance with current regulations, this can also be carried out by a representative by POA.
The Confidence Group company has submitted numerous requests to the Ministry of Internal Affairs with a request to clarify the relevancy of such requirements, eventually receiving the answer that such requirements were not legally justified by the current regulations.
Employees of the Ministry of Internal Affairs explain in oral conversations that this ensures the security of employer companies so that, without their knowledge, no third party can apply for a work permit for foreign citizens on their behalf.
If ensuring the presence of the head of the company is impossible or unacceptable, the employer company may file a complaint about unlawful actions of the Ministry of Internal Affairs to higher authorities.
