The condition for the stay of foreigners will be respect for the diverse culture and traditions, natural resources, and non-interference in the activities of public authorities in Russia and its state policy.
The draft law provides for the introduction of the following concepts into the law on the legal status of foreign citizens:
▪ Register of controlled persons - a register in which a foreign citizen or stateless person is entered fr om the date of termination of the grounds for legal stay in Russia, illegal crossing of the Russian border, a decision to refuse recognition as a refugee, a decision to reduce the period of temporary stay, deportation, readmission , undesirability of staying (residence) in Russia.
▪ Deportation regime - a legal regime applied to foreign citizens who do not have the right to legally stay in Russia. This may be due to the expiration of temporary stay in Russia or migration documents, cancellation of a temporary residence permit, residence permit, or the commission of an wrongful act.
The procedure for applying and terminating the deportation regime will be established by the Russian Ministry of Internal Affairs.
Persons included in the register of controlled persons and subject to deportation regime will be obliged to:
- appear before officials of the Ministry of Internal Affairs if an order is received;
- inform the territorial bodies of the Ministry of Internal Affairs, including in electronic form, about their location with a photographic image with a geolocation mark, if it is impossible to personally arrive at the territorial body of the Ministry of Internal Affairs;
- report that he had to change his place of residence without permission from the Ministry of Internal Affairs due to force majeure circumstances;
- about the date, place and route of the planned independent departure from Russia or about the circumstances preventing timely independent departure.
In case of repeated (two or more times) failure to fulfill these obligations in relation to a foreign citizen, decisions on deportation and placement in a special institution will be made.
Foreign citizens under deportation regime are planned to lim it their access to a number of rights and freedoms on the territory of Russia, namely:
- ban on registration of legal entities and individual entrepreneurs;
- ban on the acquisition and state registration of real estate, transport
vehicles, self-propelled vehicles and other types of equipment;
- restriction on the use of the right to drive vehicles, a ban on taking the examination for the right to drive vehicles;
- refusal to open a bank account or make a transfer funds, disposal of funds in accounts in banks and other credit institutions of Russia, with the exception of the purchase of goods at the rate of 30,000 rubles per month and travel documents for leaving Russia, payment of fines imposed by government bodies;
- ban on marriage registration;
- prohibition on changing place of residence or place of stay in Russia without permission from the territorial body of the Ministry of Internal Affairs;
- a ban on travel outside the territory of a subject of Russia, a municipal entity, with the exception of exit from Russia.
It is proposed to make corresponding changes to the laws “On acts of civil status”, “On banks and banking activities”, “On road safety”, “On state registration of real estate”, “On state registration of legal entities and individual entrepreneurs”, “On police” , “On Non-Profit Organizations”, as well as in the Family Code of Russia.
