This law also tightens a number of requirements for obtaining a temporary residence permit and a residence permit (RP) in Russia based on family relations with Russian citizens (read more in our news). The law provides for the following changes:
• A temporary residence permit obtained on the basis of marriage and a child born (adopted) together is cancelled in the event of deprivation or restriction of parental rights, cancellation of adoption, exclusion from the child's birth certificate;
• a temporary residence permit can be issued based on the fact of having a minor child if the child was born (adopted) in a marriage with a citizen of Russia, or if there is a common child with a citizen of Russia (not in a marriage) who is a citizen of Russia, provided that the fact of cohabitation directly with this child on the territory of Russia and participation in his (her) maintenance and upbringing, or cohabitation with the mother (father) of such a child and running a common household with her (him) for at least 3 years prior to the date of application is confirmed in court;
• a temporary residence permit can be issued based on the fact of having a minor child provided that the foreign citizen is the only parent (adoptive parent) of the child who is a citizen of Russia, permanently residing in Russia;
• A residence permit issued on the basis of a marriage with a Russian citizen is cancelled if such a marriage was dissolved or declared invalid by the court, and the temporary residence permit was obtained on the basis of the marriage;
• A residence permit obtained on the basis of having a born (adopted) child who is a Russian citizen and permanently resides in Russia is cancelled in the event of deprivation or restriction of parental rights, cancellation of adoption, or exclusion from the child's birth certificate.
According to the authors of the law, it is intended to combat the institution of fictitious marriage and paternity and maternity, which can be used to illegally acquire grounds for residence in Russia.
The law comes into force 90 days after its official publication, that is, on January 25, 2025.
