Attracting a foreign specialist from a visa country is always a choice between speed and cost. The employer faces a dilemma: register the employee as a Highly Qualified Specialist (HQS) or use intergovernmental agreements with France and Korea on temporary employment. Each path has its own legal and financial consequences. Below is an objective comparison that will help you make a decision without mistakes.
HQS: when speed matters more than the salary threshold
A Highly Qualified Specialist (HQS) is a foreign citizen with experience, skills or achievements in a specific field whose remuneration meets the minimum established by law.
Key change. Until March 1, 2027, for most HQS the threshold is RUB 750,000 per quarter (RUB 250,000/month). From March 1, 2027, it will rise to RUB 717,000 per month for the general case and to RUB 358,500 per month for certain categories (researchers, teachers, some IT specialists).
Who may attract HQS: Russian commercial organizations, accredited branches of foreign legal entities, scientific and educational organizations, and healthcare institutions with state accreditation.
Advantages of HQS over an ordinary permit:
-
Quotas do not apply. There is no need to wait for a quota or obtain a conclusion on the appropriateness of attracting (information to the employment center).
-
Review period — up to 14 working days.
-
Work permit — up to 3 years with extension; visa — also up to 3 years.
-
Work in several regions of the Russian Federation without a separate permit for each.
-
No exam in Russian language, history and fundamentals of legislation is required (unlike an ordinary permit).
-
Personal income tax — 13% from the first day of work (and not 30%, as for ordinary non-residents).
-
Permanent residence permit for the validity period of the work permit. After two years of work, an HQS may obtain an indefinite permanent residence permit (clause 3, Article 8 of Federal Law No. 115-FZ).
-
90 days without migration registration from the date of entry.
Restrictions and risks:
-
High salary. The threshold of RUB 717,000/month (from 2027) cuts off most employers.
-
No contributions to the Federal Compulsory Medical Insurance Fund, the Social Insurance Fund or pension provision (except injury contributions of 0.2–0.9%). As a consequence, the foreign worker does not form pension rights in the Russian Federation.
-
Insurance contributions — only “for injuries.”
Agreement with France: an alternative
The Agreement between the Government of the Russian Federation and the Government of the French Republic (ratified by Federal Law No. 393-FZ of December 28, 2010) allows French citizens to be attracted within separate categories.
Who may attract: Russian commercial organizations of one group of companies; accredited branches and representative offices of foreign legal entities.
Key categories and features:
| Category | Work permit | Visa | Term |
|---|---|---|---|
| Accredited employees of representative offices/branches | Not required | Multiple, up to 1 year | Extended without leaving, up to 3 years |

Agreement with Korea: its own nuances
The Agreement between the Government of the Russian Federation and the Government of the Republic of Korea (ratified by Federal Law No. 275-FZ of October 19, 2011, in force since January 1, 2012) is largely similar to the French one, but there are differences.
Key categories:
| Category | Work permit | Visa | Term |
|---|---|---|---|
| Accredited employees of representative offices of legal entities | Not required (within the number under accreditation) | Multiple, up to 1 year | Extended without leaving, up to 3 years |
| Employees of one group of companies | Required | Multiple, up to 1 year | Extended once up to 6 months (if necessary), then up to 3 years |
| Heads of enterprise | Required | Multiple, up to 1 year | Extended without leaving, up to 3 years |
| Accompanying family members | — | Up to 1 year | Annual extension for the term of the contract |
Advantages under the Agreement with Korea:
-
Quotas do not apply.
-
Documents may be submitted in the capitals of the states of the Parties.
-
The permit is valid throughout the territory of the receiving state.
-
For accredited employees of representative offices, permitting documents are not required within the number under accreditation.
-
No salary requirements.
-
Possibility to receive a pension and SNILS.
Disadvantages:
-
A permit to attract foreign workers is required (except for accredited employees of representative offices).
-
The full cycle takes up to 36 working days.
-
A certificate in Russian language/history/legislation is mandatory.
-
The permit and visa are at least 1 year (actually up to 1 year with extension).
-
No contributions to the Federal Compulsory Medical Insurance Fund are made.
-
Personal income tax — 13% or 30%.
-
Simplified permanent residence permit is unavailable.
Conclusion: what to choose
HQS wins in speed, validity period of documents and tax regime, but loses in cost — the salary threshold of RUB 717,000/month (from 2027) is not available to everyone.
The Agreements with France and Korea are a workable alternative for the mid segment: salary requirements are lower, pension contributions are present, but the procedure is longer and includes a Russian language exam.
If the priority is to minimize payroll costs and preserve the employee’s pension rights, choose the Agreement. If you need to legalize a key specialist quickly and for a long period and you are prepared to pay, choose HQS.
In each case there are nuances that depend on citizenship, the employee’s category and the structure of the group of companies. Professional support from Confidence Group consultants helps complete the procedure without refusals and in the shortest possible time.
