A quota for attracting foreign workers is a limit established by the Government of the Russian Federation on the issuance of work permits to foreign citizens arriving in Russia on the basis of a visa. If your company plans to hire employees from visa countries, in most cases it cannot do so without first obtaining a quota. The procedure requires preparing an application, complying with regional requirements, and interacting with authorized bodies.
In this guide, specialists from Confidence Group explain who needs a quota, how the procedure works, what requirements are imposed on the employer, and what to consider when preparing documents in order to reduce the risk of refusal.
What a quota is and why it is needed
The need for foreign workers is determined taking into account the situation on the regional labor market, the possibility of employing Russian citizens, and the needs of the economy. Obtaining a quota is one of the stages of attraction: after the need is agreed upon and the quota is approved, the employer, if necessary, obtains a permit to attract and use foreign workers, as well as work permits for specific foreign citizens.
A quota is not required for highly qualified specialists (HQS), citizens of the EAEU (Belarus, Kazakhstan, Armenia, Kyrgyzstan), and certain categories provided for by law.

Who needs a quota for attracting foreign workers
A quota is required if the employer attracts foreign citizens who arrive in Russia under the visa procedure, within the limits established for the constituent entity of the Russian Federation and the industry. Before starting the procedure, it is necessary to check the citizenship of the future employee, the proposed position, and the possibility of obtaining permits without taking the quota into account.
Quota-exempt positions: attraction without a quota
A separate category is positions to which the quota does not apply. The list of such positions and professions is approved at the legislative level and is periodically updated. In practice, this means that the employer may attract foreign workers to quota-exempt positions without obtaining a quota, and the work permit is issued in the general procedure, but without the quota procedure—this significantly shortens the timelines and simplifies attraction.
The current list of quota-exempt positions is available via the link.
Important: the list will be updated in the near future—presumably from January 2027, when the authority to form such a list will transfer to the Ministry of Internal Affairs. When attracting a foreign worker to a quota-exempt position, passing an exam in the Russian language, Russian history, and the fundamentals of Russian legislation is required. Under the quota procedure, the exam is not required. Read more about obtaining a quota.
General director position: quota for small business
The position of general director is a quota position for small business entities: small business companies cannot obtain a work permit for this position without a quota. Medium and large companies can obtain a work permit for this position without a quota—for them it is classified as quota-exempt. Before applying, it is necessary to confirm the company’s category in accordance with the legislation (by number of employees, revenue, and other criteria).
Who may submit documents for a quota
The applicant may be a legal entity registered in the territory of the Russian Federation, an individual entrepreneur, as well as an individual—for attracting foreign citizens for personal purposes (nannies, domestic workers), including:
· limited liability companies (LLCs);
· joint-stock companies (JSCs, PJSCs, closed joint-stock companies);
· unitary enterprises;
· non-commercial organizations—if they have economic activity and a need for workers;
· individual entrepreneurs (IEs)—as employers;
· individuals—for attracting foreign citizens for personal purposes.
What will be an advantage when the application is considered
· absence of violations of legislation, including migration legislation;
· timely payment of taxes and absence of debt to the budget;
· financial stability of the company;
· length of time operating in the market—a stably operating business is regarded as a more reliable employer;
· number of employees and scale of activity;
· distribution of shares of foreign and Russian employees in accordance with officially established standards.
Any other factors confirming the reliability and importance of the employer for the region may also be taken into account: the presence of government contracts, participation in significant regional projects, investment activity, creation of jobs for local residents. The list of such factors is not closed—the commission evaluates the application as a whole.
How the quota procedure works: 7 stages
The general procedure for determining the need for foreign workers is established by Order of the Ministry of Labor of Russia No. 27n dated 23.01.2014 (currently the version of the order dated 22.05.2026 is in force). Employer applications are considered by the authorized body of the constituent entity of the Russian Federation and the interdepartmental commission. The specific procedure for submitting documents, the methods of their submission, and the calendar of application acceptance should be clarified in the region where the labor of foreign workers is planned to be used.
Stage 1. Checking requirements and preparing the application
The employer determines the number of foreign workers needed, the positions, qualification requirements, expected salary, and the region of employment. At this stage, it is important to check the relevance of information about the employer in the Unified State Register of Legal Entities (EGRUL) or the Unified State Register of Individual Entrepreneurs (EGRIP), the compliance of the planned need with the real staffing need, the presence of restrictions on attracting foreign workers in the relevant industry, compliance with legislative requirements, and the need to provide guarantees of medical and housing support for foreign workers in cases provided for by law.
Stage 2. Checking the regional procedure and submission deadlines
The application is submitted to the authorized body of the relevant constituent entity of the Russian Federation. Regional bodies publish schedules for accepting applications and information on the procedure for their submission. The employer must check in advance the current schedule on the official website of the regional labor and employment body or contact the authorized body directly for clarification.
Example for Moscow: applications are accepted by the Department of Labor and Social Protection of the Population of the City of Moscow. The submission procedure provides for interaction with the “Migration Quotas” information system and submission of documents in accordance with the published schedule. For employers from other regions, different deadlines, document package requirements, and additional organizational procedures may apply. In some regions, documents may be submitted using an electronic digital signature.
Stage 3. Posting information about vacancies
When preparing the application, it is necessary to take into account the region’s requirements for posting information about vacancies and interaction with the employment service. Legal entities—employers—post information about the need for workers on the “Work in Russia” portal ( trudvsem.ru). When posting a vacancy, it is important to correctly indicate the position, qualification requirements, and remuneration terms.
Stage 4. Filling out the application in the “Migration Quotas” system
The application on the need to attract foreign workers is drawn up in the established form. Depending on the applicable procedure, documents may be submitted on paper or in electronic form using the information and analytical system “Migration Quotas” ( migrakvota.gov.ru). The application must contain the information provided for by the form: information about the employer, the number of foreign workers needed, professions, specialties and positions, expected remuneration terms, states of citizenship of the workers, and other necessary information. If the information or formatting does not meet the requirements, the authorized body may reject the application.
Stage 5. Submission of the application and consideration by the interdepartmental commission
After preparation, the application is sent to the authorized body of the constituent entity of the Russian Federation in the procedure and within the deadlines provided for by the regional schedule. The commission evaluates the employer’s need taking into account legislative requirements, the situation on the regional labor market, and the possibility of meeting the staffing need through Russian workers. According to Order of the Ministry of Labor of Russia No. 27n, the authorized body sends the received application for consideration by the commission within the established period, and the commission makes a decision no later than 15 days from the date the application is received by the authorized body. This period relates to consideration of the application at the regional level and does not mean that the entire procedure for obtaining a quota will be completed within 15 days.
Stage 6. Receiving the decision and approving the quota
Based on the results of consideration, the application may be granted in full, in part, or rejected. Information about the decision is communicated to the employer in the established procedure. The regional body then forms and sends proposals on the need for foreign workers to the Ministry of Labor of Russia in accordance with federal rules. The allocation of the quota is carried out in the established procedure after the necessary decisions are made and the relevant indicators are approved. Submission of an application does not guarantee allocation of a quota in the requested volume.
Stage 7. Processing permits
After the quota is allocated, the employer must determine the further procedure for processing permits. The procedure includes obtaining a permit to attract and use foreign workers (read more), issuing an invitation to enter for the purpose of employment (read more), and obtaining a work permit for a specific foreign citizen (read more). The quota itself is not a work permit and does not give the right to immediately allow a foreign citizen to work.
When to submit an application for a quota
There is no single application submission calendar that is the same for all regions of Russia. Deadlines are set taking into account the regional procedure for considering the need for foreign workers and published schedules. An application for the next year must be prepared in advance, focusing on the deadlines announced by the authorized body of the relevant region.
Schedules for submitting applications for Moscow and the Moscow Region are regularly published on the Confidence Group website. Follow the updates.
How long it takes to obtain a quota
The overall period depends on the region, the date of application submission, the consideration schedule, and the subsequent processing of permits. It is necessary to take into account not only the time of consideration of the application by the regional commission, but also the subsequent stages of quota approval, as well as obtaining a permit to attract foreign workers and work permits. Therefore, a universal period for obtaining a quota for all regions cannot be established; approximately, the timelines range from 3.5 to 6 months.
What factors are taken into account when considering the application
When determining the need for foreign workers, the commission is guided by the criteria provided for by Order of the Ministry of Labor of Russia No. 27n. In particular, the following are taken into account:
1. Information about the employer. Registration information in the EGRUL or EGRIP and the compliance of the data in the application with the information in the state register are checked.
2. The possibility of attracting Russian workers. The possibility of meeting the need through regional labor resources is assessed, including through training, redistribution of workers, and attraction of citizens from other constituent entities of the Russian Federation.
3. Remuneration terms. The salary indicated in the application must exceed the applicable subsistence minimum for the able-bodied population and the minimum wage in the relevant constituent entity of the Russian Federation.
4. The possibility of arranging foreign workers. The availability of housing, social infrastructure facilities, and medical care in the region is taken into account.
5. Medical and housing support. The provision by the employer of the relevant guarantees in cases provided for by legislation is considered.
6. Compliance with legislation. The absence of unresolved violations by the employer of labor, migration, tax legislation, legislation on social and medical insurance, social protection of persons with disabilities, and employment of the population is taken into account.
7. Compliance with restrictions on attracting foreign workers. Compliance with the permissible share of foreign workers in the relevant sectors of the economy and other applicable requirements is checked.
These criteria are assessed as a whole.
Main grounds for refusal to allocate a quota
In accordance with Order of the Ministry of Labor of Russia No. 27n, an application may be rejected in full, in particular, in the following cases:
· the employer submitted inaccurate information or forged documents, or knowingly communicated false information;
· bankruptcy proceedings have been initiated against the employer;
· the application does not meet the established criteria for determining the need for foreign workers.
In particular, the risk of rejection arises if the need for workers can be met through regional labor resources, the specified remuneration terms do not meet the established requirements, or other applicable criteria are not met. The application may also be granted in part if the employer’s need meets the established requirements not in full.
How to reduce the risk of refusal: 7 recommendations
1. Check the applicability of the quota procedure. Make sure that a quota is actually required for the proposed foreign worker and position.
2. Clarify regional deadlines and requirements. Check the current schedule for accepting applications and the procedure for submitting documents.
3. Check information about the employer. Make sure that the application data corresponds to the information in the EGRUL or EGRIP.
4. Justify the staffing need. Correctly indicate the number of workers, positions, qualification requirements, and remuneration terms.
5. Check compliance with legislation. Identify and eliminate violations that may be taken into account when considering the application.
6. Prepare the necessary guarantees and documents. Clarify which confirmations of medical and housing support are required in the specific situation.
7. Monitor the status of the application. Respond promptly to requests from authorized bodies and eliminate comments if documents are returned for revision.
Compliance with these recommendations does not guarantee allocation of a quota, but it allows reducing the risk of errors and delays related to the preparation and submission of the application.
